Agreement to These Terms

These Terms and Conditions (the "Terms") are a binding agreement between you ("you," "Client") and Returning to Self an LLC operated by Dianne Maxon in Sunnyvale, California ("we," "us," "our," or the "Practice").

They govern your use of www.returningtoself.com (the "Site") and all services we provide, including intuitive consulting, mediumship readings, energy work, courses, events, and digital materials (collectively, the "Services").

By booking a session, making a payment, creating an account, or using the Site, you accept these Terms, our Disclaimers, and Privacy Policy (see separate Privacy Policy). If you do not accept them, do not use the Services.

Eligibility:  You must be at least 18 years old and legally able to enter into a contract to use the Services. We do not knowingly provide Services to minors. We may ask you to confirm your age and may refuse or cancel a booking if we believe you are under 18.  If you are booking on behalf of someone else, you represent that you have their authority to do so and that they meet these eligibility requirements.

DISCLAIMERS: 

What the Services Are — and What They Are Not: We offer intuitive consulting, mediumship, and energy-based practices. This is sincere spiritual work, offered in good faith. It is also, by its nature, subjective and interpretive. Dianne Maxon is not a licensed physician, psychologist, psychotherapist, marriage and family therapist, clinical social worker, professional clinical counselor, dietitian, attorney, accountant, or investment adviser — unless separately and expressly stated in writing, in which case that licensed service is provided under a separate agreement, not this one.

These services do not include: medical care, diagnosis, treatment, or a prescription; psychotherapy, counseling, or mental health treatment as those terms are defined under California Business & Professions Codes: legal, tax, accounting, insurance, or investment advice; a substitute for care from a licensed professional in any of those fields; a crisis, emergency, or suicide-prevention service.

If you are in crisis, please reach out to one of these resources or to a licensed professional that is the right support for that moment, and this work is not a substitute for it.

  • Immediate danger: call 911.

You are solely responsible for every decision you make. The Services are offered for your reflection and consideration. They are not predictions you should rely upon, and no outcome is promised or guaranteed;. Using the Services does not create a doctor–patient, therapist–client, attorney–client, fiduciary, or agency relationship. We owe you the duties set out in these Terms and no others. Because we are not a licensed healthcare provider or member of the clergy acting in that capacity, what you tell us is not protected by physician–patient, psychotherapist–patient, or clergy–penitent privilege, and is not covered by HIPAA. We hold your information in confidence as a matter of professional practice and under our Privacy Policy, but a court could compel its disclosure. Please keep this in mind when deciding what to share. We may disclose information you share where we reasonably believe it is necessary to prevent imminent serious harm to you or another identifiable person, or where the law requires it.

Disclaimer of Warranties: To the fullest extent permitted by law, the Services and the Site are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that any reading, message, impression, or guidance will be accurate, complete, verifiable, or beneficial, or that any particular result will follow. We do not warrant that the Site will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Booking, Fees, and Payment

Booking. Sessions are booked through ReturnToSelf.com/Acuity or by contacting us directly. A booking is confirmed only when you receive written confirmation from us.

Fees. Current fees are listed at www.returningtoself.com/schedulesession. Fees are quoted in U.S. dollars and are subject to change; the fee in effect when you book is the fee that applies to that booking.

Payment. Payment is due in full at the time of booking. We accept credit cards which are processed through a third party payment processor. We do not receive or store your full card number. Your use of the payment processor is also subject to its own terms and privacy policy..

Failed payments and chargebacks. If a payment fails, we may suspend Services until it clears. If you initiate a chargeback for a session you attended, we may recover the disputed amount plus any processor fees, and may decline future bookings.

Taxes. Fees are exclusive of any applicable taxes, which are your responsibility where they apply.

Cancellation, Rescheduling, and No-Shows

Your cancellations. You may cancel or reschedule with at least 24 hours' notice at no charge. Notice must be given by info@returningtoself.com. Late cancellation. Cancelling with less than 24 hours’ notice forfeits 100% of the session fee, or one session from a package.

Late arrival. Sessions end at their scheduled time unless the provider has flexibility at that particular time and date. Arriving late may shorten your session; the full fee still applies.

Our cancellations. If we must cancel or reschedule, we will give you as much notice as we can and will offer you, at your choice, a rescheduled session or a full refund of amounts paid for that session.

Discretion. We may waive these charges in cases of emergency, illness, or bereavement, at our discretion and without setting a precedent.

Refunds.: Because the Services are subjective and personal in nature, and because our time is reserved exclusively for you, fees for sessions that have taken place are non-refundable. You are paying for the practitioner's time, attention, and preparation — not for a particular result, message, or outcome. See our Disclaimers. Regarding Digital recordings, because these are delivered instantly and cannot be returned, they are non-refundable once accessed or downloaded, except where required by law. For Events and workshops. Tickets are refundable up to 7 days before the event; after that they are non-refundable and are not transferable to another attendee. Approved refunds are returned to the original payment method within 10 business days. Processing fees are non-refundable.

Recording and Confidentiality: We do not record without your consent. California Penal Code § 632 requires the consent of all parties to record a confidential communication. We will record a session only with your express prior consent. You may not record without our consent. You may not record, photograph, livestream, or transcribe any session, course, or event without our express prior written consent. Recording us without consent may expose you to criminal and civil liability under California law and is a material breach of these Terms. Use of recordings. Where we provide a recording to you, it is for your personal, non-commercial use only. You may not publish, post, sell, or share it — in whole or in part — without our written permission.

Group sessions and classes: In group sessions, courses, and events, other participants will hear what you share. We ask all participants to keep what they hear confidential, but we cannot control or guarantee their conduct. Share only what you are comfortable having others hear. Your agree to the following Responsibilities and Conduct during sessions and classes: Provide accurate information when booking and completing intake forms; arrive on time, sober, and not under the influence of anything that would impair your participation; treat us and other participants with respect; take responsibility for your own decisions, actions, health, and wellbeing; continue any care prescribed by a licensed professional and consult that professional before changing it. We may end a session immediately and without refund, and decline future bookings, if you are abusive, threatening, harassing, intoxicated, or disruptive, or if you record without consent.

Non-discrimination. We serve clients without regard to any characteristic protected under California's Unruh Civil Rights Act. Our right to decline service is exercised only for the conduct-based reasons stated above.

Content, Testimonials and Feedback: The Site and all materials we produce — text, images, audio, video, course content, workbooks, exercises, and methods — are owned by us or our licensors and protected by copyright and trademark law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use materials we provide for your own personal, non-commercial use. You may not copy, reproduce, distribute, sell, republish, teach from, or create derivative works from them without our written permission. You keep ownership of anything you submit to us. By submitting it, you grant us a non-exclusive, royalty-free license to use it to provide the Services and to administer our business. We will use your name, likeness, or words in marketing only with your express written permission, which you may withdraw at any time by writing to info@returiningtoself.com. We will remove the testimonial from materials we control within 30 days of your request. If you send us suggestions for improving the Services, we may use them freely and without obligation to you.

Third-Party Platforms and Links: The Services rely on third-party platforms for scheduling, payment, video, and email. We are not responsible for their availability, security, or conduct, and your use of them is governed by their own terms. Links from the Site to third-party sites are provided for convenience only and are not endorsements.

Assumption of Risk: Spiritual consulting, mediumship, and energy work can surface strong emotions — including grief, sorrow, anger, and distress — and can raise material you did not expect. You may hear things that are unwelcome, inaccurate, or upsetting. You knowingly and voluntarily accept these risks and assume full responsibility for your emotional and physical wellbeing during and after any session. You confirm that you are entering into the Services of your own free will, that you have read our Disclaimers, and that you are not relying on the Services to diagnose, treat, or resolve any medical, psychological, legal, or financial matter.

Limitation of Liability and Indemnification:  To the fullest extent permitted by California law: Our total aggregate liability to you for any claim arising out of or relating to the Services or these Terms will not exceed the total amount you paid us in the six (6) months immediately preceding the event giving rise to the claim.  We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, emotional distress, or damages arising from decisions you made after or because of a session even if we were advised such damages were possible. You agree to indemnify and hold harmless Returning to Self, LLC, Dianne Maxon, and our contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Services or the Site; (c) your violation of any law or third-party right, including unauthorized recording or republication; or (d) decisions or actions you took following a session. This does not apply to claims arising from our own fraud, willful misconduct, or gross negligence.

Term, Termination, and Suspension: These Terms apply for as long as you use the Services. Either party may end the relationship at any time. We may suspend or terminate your access immediately for breach of these Terms. Termination does not entitle you to a refund unless initiated by us.

Communication: You consent to receive communications from us electronically, and agree that electronic communications, agreements, and notices satisfy any legal requirement that they be in writing. We use email for confirmations, reminders, and — where you opt in — newsletters. You may unsubscribe from marketing email at any time using the link in each message. You cannot unsubscribe from transactional messages about a booking you have made.. We do not record telephone calls unless you consent in advance, as described in Section 8.

Changes to These Terms: We may revise these Terms from time to time. The "Last Updated" date will change and the current version will always be posted at www.returningtoself.com/terms. Material changes take effect 14  days after posting, and we will notify existing clients by email. The version of these Terms in effect at the time you book governs that booking. Continuing to use the Services after the effective date constitutes acceptance.

General Provisions: Entire agreement. These Terms, together with the Privacy Policy and Disclaimers, are the entire agreement between us and supersede all prior discussions and representations; If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions continue in full force; our failure to enforce any provision is not a waiver of our right to enforce it later; you may not assign these Terms. We may assign them in connection with a sale or transfer of the Practice.

Force majeure. Neither party is liable for delay or failure to perform due to causes beyond its reasonable control, including natural disaster, fire, power or internet failure, illness, government action, or public emergency. We will reschedule or refund affected sessions.

Independent status. Dianne Maxon provides the Services as an independent practitioner. Nothing here creates a partnership, joint venture, employment, or agency relationship
